Framework and authorities
Who may be in scope
The Danish Anti-Money Laundering Act (hvidvaskloven) applies to the listed business types, professionals and activities in section 1, including specified financial firms and non-financial gatekeepers. A firm must identify its actual legal entity and activity against that statutory list before treating a customer or product as in scope. The retained LBK 433/2026 XML is a dated source edition, not a complete 11 October consolidation: its metadata gives an end date of 9 September 2026.
Risk controls and financial sanctions
The retained section 7 text requires in-scope entities to identify and assess money-laundering and terrorist-financing risk using their business model and the stated customer, product, service, transaction, delivery-channel and geographic factors. Section 8 sets written policy, procedure and control requirements. Act 764/2026 later added proliferation-financing risk and financial-sanctions control requirements and independent testing for the stated perimeter. Its section 1 nos. 1-8 also affect AML Act sections 51, 55 and 60, alongside sections 4a, 7, 8 and 74. These successor changes are separately retained but not integrated into the 118-unit baseline; none of those retained entries is represented as a reconciled October-current control.
National freeze route, not a screening result
AML Act section 34a(3) requires a covered undertaking or person to freeze without undue delay funds owned or held by a person, group or entity named on the designated Danish authority website under section 34a(1); that statutory freeze duty ends when the name is removed from the website. Act 764 changes related assessment and policy controls. No Danish, European Union or United Nations designation list was retained and reconciled here, and no person or transaction was screened. The legal mechanism is not evidence that a screening feed is current or complete.
Risk, sanctions and limits
Risk assessment is firm-specific
The Act's factors guide firm-specific risk assessment, not a sector score. The 2022 National ML Risk Assessment runs through 2025: bank laundering risk is high (pp. 167-168); payment-services risk is significant on average, with provider/product variation (pp. 184-190); cryptoasset misuse risk is significant; criminal use is expected to rise (pp. 149-150). It identifies high tax/VAT and IT-related economic crime threats and significant narcotics/doping threats (p. 5). These are dated national findings, not a firm's rating or a 2026 assessment. The FIU's 11 October index links this assessment and method materials; it does not establish that no newer report exists.
FATF and list currentness remain open
FATF's 27 May 2026 technical-compliance table records Denmark's combined evaluation/follow-up as Feb-21: history, not an October evaluation, effectiveness finding or public-list classification. Only the scoped official row transcript and access-attempt evidence are retained; full-PDF and profile fetches returned HTTP 403 at capture. No current Danish, EU or UN designation list, ownership/control match or screening result was checked. Identify the applicable regime and current official source: nationality, residence or corridor alone is not a designation match.
Commencement and coverage boundary
Act 764 section 20(1) commences on 15 September 2026. Section 20(2) defers its own section 8 no. 1 (Consumer Loan Businesses Act section 1(2)) and section 16 no. 1 (repeal of Act 1322/2025 section 3 no. 4) to 20 November, NOT AML Act sections 8 or 16. Its section 1 nos. 1-8 affect AML sections 4a, 7, 8, 51, 55, 60 and 74; successor wording is not integrated into the 20 April baseline. This is one principal Act and one bounded amendment, not the complete Danish corpus or a confirmed October position. No future EU AML Regulation duty or EEA equivalence is inferred.
Selected firm implications
Meaning: The section sets enhanced checks for a cross-border correspondent relationship involving payments with a respondent institution outside the European Union in the stated circumstances.
Conditions: Applies before establishing the correspondent relationship described in the section; its geography, payment and agreement predicates must all be checked against the full Danish wording.
Exceptions: The extra subsection 1 checks supplement section 11 CDD and are limited to the specified cross-border relationship. Subsection 3 is conditional on direct customer access; no exception to the four listed checks is stated.
Suggested action: Complete the specified respondent due diligence and obtain the required senior approval before establishing the covered correspondent relationship.
National Legislation / Legislation / Retained legislation edition; current legal effect unverified · § 19.Meaning: The section addresses transactions, funds or activity linked to money laundering or terrorist financing, including attempted transactions and relevant prospective-customer enquiries. It has separate lawyer-relay, post-completion, major/particularly suspicious transaction and terrorist-financing rules.
Conditions: Only actors within the Act and the knowledge, suspicion or reasonable-grounds trigger in the relevant subsection; timing and hold/approval consequences differ by subsection.
Exceptions: A member of the Danish Bar and Law Society may use its secretariat relay; the secretariat must forward the report unedited if it assesses the reporting duty applies. Subsection (3) alone allows immediate reporting after completion if stopping is impossible or could harm the investigation; this alternative is not extended to subsections (4) and (6). The next-banking-day deadline is for arranging a seizure decision, not automatic approval.
Suggested action: Report immediately when the statutory knowledge, suspicion or reasonable-grounds trigger is met. Hold under subsection (3); in subsection (4) and (6) cases, do not proceed until reporting and FIU approval have both occurred.
National Legislation / Legislation / Retained legislation edition; current legal effect unverified · § 26.Meaning: The national statutory route depends on the authority's published name and the covered undertaking/person; removal ends this particular statutory freeze duty.
Conditions: The source list entry, ownership or holding of funds, covered-person scope, applicable regime and removal status must be verified. No list or customer match was performed in this research.
Exceptions: The specific statutory freeze duty ceases when the name is removed from the Danish authority website under subsection 2. This does not displace any other applicable sanctions obligation.
Suggested action: Without undue delay, freeze covered funds owned or held by a person, group or entity while its name remains on the designated authority website.

Retail bank
Meaning
The section sets enhanced checks for a cross-border correspondent relationship involving payments with a respondent institution outside the European Union in the stated circumstances.
Full public provision explanation
Before entering the specified cross-border payment correspondent relationship, perform section 11 CDD plus four extra checks: understand the respondent and assess its reputation/supervision from public information; confirm its effective AML/CTF controls; obtain approval from the section 7(2) appointee; and document each party’s compliance responsibilities. Before crypto-asset services, check the respondent’s local authorisation/registration. If the respondent’s customer can directly use funds in the correspondent account, ensure the respondent does CDD and can provide its records on request.
Suggested action
Complete the specified respondent due diligence and obtain the required senior approval before establishing the covered correspondent relationship.
Conditions
Applies before establishing the correspondent relationship described in the section; its geography, payment and agreement predicates must all be checked against the full Danish wording.
- Subsection 1 applies before a cross-border correspondent relationship involving payments with a respondent institution outside the EU where the EU has no financial-services agreement with the relevant country. Subsection 2 applies before crypto-asset services. Subsection 3 applies if a respondent’s customer has direct access to funds held in an account with the correspondent.
Exceptions
The extra subsection 1 checks supplement section 11 CDD and are limited to the specified cross-border relationship. Subsection 3 is conditional on direct customer access; no exception to the four listed checks is stated.

Payments and e-money
Meaning
The section addresses transactions, funds or activity linked to money laundering or terrorist financing, including attempted transactions and relevant prospective-customer enquiries. It has separate lawyer-relay, post-completion, major/particularly suspicious transaction and terrorist-financing rules.
Full public provision explanation
Report immediately when the statutory knowledge, suspicion or reasonable-grounds test is met, including the specified attempts and prospective-customer enquiries. Under subsection (3), hold an uncompleted money-laundering transaction until reporting, subject to that subsection's narrow post-completion alternative. Subsections (4) and (6) separately require reporting and Secretariat approval where there is knowledge, suspicion or reasonable grounds concerning major/particularly suspicious money laundering or terrorist financing. The next-banking-day deadline concerns a seizure decision, not deemed approval.
Suggested action
Report immediately when the statutory knowledge, suspicion or reasonable-grounds trigger is met. Hold under subsection (3); in subsection (4) and (6) cases, do not proceed until reporting and FIU approval have both occurred.
Conditions
Only actors within the Act and the knowledge, suspicion or reasonable-grounds trigger in the relevant subsection; timing and hold/approval consequences differ by subsection.
- The immediate-report trigger is knowledge, suspicion or reasonable grounds concerning a transaction, funds or activity connected with money laundering or terrorist financing; it also covers the specified attempts/enquiries. Subsection (3) requires holding an uncompleted money-laundering transaction until reporting. Under subsections (4) and (6), knowledge, suspicion or reasonable grounds concerning major/particularly suspicious money laundering or terrorist financing requires reporting and Secretariat approval before proceeding.
Exceptions
A member of the Danish Bar and Law Society may use its secretariat relay; the secretariat must forward the report unedited if it assesses the reporting duty applies. Subsection (3) alone allows immediate reporting after completion if stopping is impossible or could harm the investigation; this alternative is not extended to subsections (4) and (6). The next-banking-day deadline is for arranging a seizure decision, not automatic approval.

Crypto and digital assets
Meaning
The national statutory route depends on the authority's published name and the covered undertaking/person; removal ends this particular statutory freeze duty.
Full public provision explanation
The Minister may appoint the Danish authority that publishes names appearing on UN sanctions lists. A name is removed from that Danish website when it is included in a published EU legal act, a decision is made not to include it in such an act, or the UN removes it. While a name remains on the Danish authority website, every person or undertaking covered by the Act must freeze funds owned or held by that named person/group/entity without undue delay; the Act’s specific freeze duty ends when the name is removed. This does not establish completeness of any UN, EU or other current list.
Suggested action
Without undue delay, freeze covered funds owned or held by a person, group or entity while its name remains on the designated authority website.
Conditions
The source list entry, ownership or holding of funds, covered-person scope, applicable regime and removal status must be verified. No list or customer match was performed in this research.
- Applies to undertakings and persons covered by the AML Act when a person, group or entity is named on the Danish authority website under subsection 1. The freeze covers funds owned or held and must occur without undue delay.
Exceptions
The specific statutory freeze duty ceases when the name is removed from the Danish authority website under subsection 2. This does not displace any other applicable sanctions obligation.
- The specific statutory freeze duty ceases when the name is removed from the Danish authority website under subsection 2. This does not displace any other applicable sanctions obligation.
