Framework and authorities

National framework and reporting route

Belgium's Act of 18 September 2017 is the principal preventive AML/CFT statute. The retained Book II covers organisation, risk assessment, due diligence, reporting and records. Article 5 actor/activity scope and Article 85 supervisory allocation must be checked separately: a bank, payment provider or investment label is not a legal applicability decision. NBB and FSMA maintain their respective statutory/regulatory and supervisory reference material; the NBB index lists its 21 November 2017 AML regulation. CTIF-CFI is the financial intelligence unit. Its retained reporting page requires goAML rather than paper or email reports. Confirm the correct entity registration and reporting route; none was attempted here.

Dated law, completed bounded analysis

This draft fully translates and analyses the official Book II (articles 8-63, including 41/1) and all four annexes: 61 units. The whole statute is extracted and inventoried (219 units), but the other 158 are not semantically analysed. French and Dutch retained Justel editions are consolidated through 28 July 2026, not certified current today. Later commencement, amendment effects and savings remain unreconciled. The 15 July Act amends the AML predicate definition; its Article 35 differentiates commencement. The three examples below are version-pinned dated legislation, not confirmed current duties.

First practical step

Identify the legal entity, activity, customer and transaction, confirm Article 5/85 scope and the operative edition and sector rules, then compare the workflow with the independently reviewed dated examples. Resolve currentness before treating them as present-day requirements. Reviewed own-analysis covers 61 Book II/annex units, including 48 mapped duties; 158 other inventoried units remain unanalysed. Originals and full translations remain private analysis-only pending rights review.

Dated risk, FATF and sanctions context

Public risk synthesis, not the full NRA

The accessible public ML synthesis describes a September 2023 update adopted on 25 March 2024. Pages 1-2 discuss threats, vulnerabilities and residual risk, with drug trafficking and criminal use of legitimate construction, property, hospitality and logistics businesses. Page 7 describes virtual IBAN opacity that can complicate identification of the underlying account and tracing, and higher vulnerabilities for some private-banking, correspondent and transfer services. Use these dated findings as inputs to the firm-specific Article 16 assessment, not as a national, firm or customer score. The full underlying NRA and a current comprehensive TF/CPF assessment were not retained.

FATF: dated evaluation status only

FATF's official publication page dates the evaluation to 16 December 2025, based on the January-February 2025 visit, and reports enhanced follow-up at publication. That is evaluation follow-up, not a current increased-monitoring or high-risk-list classification. Direct PDF retrieval returned HTTP 403 during collection; the reviewer accessed its frontmatter through the web tool on 11 October 2026. The whole report is not locally retained or reviewed. No report grades or current list status are asserted.

Sanctions are a distinct instrument-level question

Article 8 links internal controls to binding financial embargoes, but AML reporting is not a substitute for sanctions compliance. The 1995 UN implementation Act and 2003 EU restrictive-measures Act provide distinct national implementation/enforcement layers; their retained text includes 2026 amendments. Treasury describes the administrative financial-sanctions and authorisation route. For a transaction, identify the actual EU, UN or national measure, territorial/person nexus, assets and ownership/control, prohibited conduct, exception or licence and reporting authority. No designation list, match, licence or transaction was checked; no automatic EU-to-EEA extension is assumed.

3

Selected firm implications

Meaning: Relationship entry has no threshold; suspicion and identity doubts independently trigger checks.

Conditions: Check obliged-entity scope and the precise Article 21 limb. The domestic goods/services transfer exclusion requires all four account, provider, traceability and amount conditions.

Exceptions: Lower prescribed thresholds may apply. Articles 25/32 e-money derogations need separate assessment.

Suggested action: Identify and verify relationship customers before onboarding (Article 30). For occasional activity, distinguish linked transactions of at least EUR 10,000 from qualifying linked credit transfers or funds transfers over EUR 1,000. Those qualifying transfers trigger checks at any amount when the relevant funds are received in cash or anonymous e-money.

National Legislation / Legislation / Retained legislation edition; current legal effect unverified · Article 21

Meaning: Funds/facts reporting is separately immediate on the specified knowledge/suspicion grounds.

Conditions: Check Article 47 reportability, Article 5 actor scope and Articles 49/50 reporting route.

Exceptions: Postponement must be impossible owing to the transaction's nature or liable to prevent prosecution of its beneficiaries. Articles 52/53 legal-professional rules are not a bank/payment/investment exemption.

Suggested action: Report an Article 47 transaction immediately to CTIF before execution, state any execution deadline and follow CTIF instructions. Under the statutory exception, report immediately afterwards and explain why prior reporting was impossible.
