RegCanary analysis of a BAFIN publication
Why it matters
RegCanary's analysis of what this means for regulated firms.
The regulator says the firm offers financial services in Germany without the required permission. The company gives a Northern Cyprus address while using a German landline — a common cross-border fraud indicator. This is a targeted investor-protection and financial-crime alert, not a new rule, so direct compliance obligations are limited.
However, regulated firms should treat the warning as a live counterparty and payment-risk signal. Compliance teams should screen clients, beneficial owners, payment beneficiaries and introducers against the named entity and domain; review transaction-monitoring rules for related contact details; and escalate suspicious activity to AML/CFT teams and, where appropriate, the FIU. Customer-facing staff should be ready to explain BaFin’s warning and direct customers to the BaFin company database to check authorisation.
Firms should also check whether their own brands, staff or payment rails are being misused. No implementation deadline applies. The earlier 12 February 2025 warning shows this is a recurring risk.
Boards should consider enhanced monitoring, domain-blocking or customer education. Authorised providers and RegTech vendors can differentiate through transparency and robust fraud detection.
