Public Malta AML/CFT research preview, checked against official source locators on 28 September 2026. It identifies candidate instruments and mappings for retail banking, payments/e-money and crypto, but does not state verified current legal requirements. Currentness, exact provisions, entity perimeter and applicability remain under review. Selected official legislation, FIAU, and authority artifacts are retained flat and fingerprinted for internal evidence review; four official endpoints remain without retained originals after HTTP 403 responses. No republication or broader reuse permission is inferred. This is not comprehensive legal coverage or compliance approval.
Review the current legal and supervisory sources for entity-level risk assessment, controls, ownership and review responsibilities.
guidance

Candidate locators: PMLFTR regs. 3-5; FIAU Implementing Procedures Part I ch. 2. Exact clauses and activity scope remain unverified.
Review pending
Establish when customer due diligence is required and which information is mandatory for the selected customer and activity.
legislation

Candidate locators: PMLFTR regs. 7(1), 7(5)-(8); FIAU Implementing Procedures Part I §§4.3.1-4.3.3. Exact customer-type and activity mapping remains under review.
Review pending
Determine which independent and reliable verification methods are permitted or required for each customer and onboarding channel.
legislation

Candidate locators: PMLFTR reg. 7(1)(a); FIAU Implementing Procedures Part I §§4.3.1-4.3.3. Exact accepted evidence, channel conditions and activity mapping remain under review.
Review pending
Identify the current Malta provisions, definitions, approval steps and enhanced measures for PEP-related relationships.
legislation
Government of Malta, Legislation Malta, Financial Intelligence Analysis Unit
Candidate locators: PMLFTR regs. 11(3)-(10) and FIAU Implementing Procedures Part I §4.9.2.2. Exact PEP scope and measures remain to be checked.
legislation / Review pending
Confirm the entity perimeter before mapping AML governance
Unverified research interpretation
Determine the legal entity, authorisation, service, customer, channel and territorial facts that decide which Malta AML/CFT framework applies.
Research explanation under review
The official source inventory points to the PMLA, PMLFTR and FIAU procedures, but the current amendment chain and the applicability of each regime to an individual bank, payment firm or crypto service are not fully reconciled. A product label alone does not establish that a business is an obliged entity or identify its supervisor.
Official consolidation published 9 February 2024; the live ELI relation list shows amendments through Act VI of 2024. Post-2024 completeness is not established.
Official ELI page identifies the Chapter as in force and carries a copyright notice. Do not infer currentness through 28 September 2026 from this point-in-time consolidation.

Map AML record classes, retention triggers and handling
Unverified research interpretation
For the checked statutory record classes, apply the relevant five-year period from the event specified for that class; separately verify residual FIAU-directed records and any other legal hold.
Research explanation under review
The retained official English and Maltese PMLFTR consolidations dated 1 April 2026 set five-year periods for the record classes in regulation 13(1)(a)-(f). Regulation 13(2)(a) starts the CDD-record clock when the relationship ends or the occasional transaction occurs; if termination formalities cannot be observed, it starts on the last relationship transaction. Regulation 13(2)(b) expressly starts the statutory period for transaction-reconstruction evidence from the relationship end or occasional transaction, with the same last-relationship-transaction fallback. FIAU Part I §9.3.2 separately describes the start event for transaction documentation under §9.2(c) as completion of dealings in that transaction, and for other records about the relationship itself as relationship termination (or last relationship transaction where closure formalities cannot be observed). This distinction narrows the apparent conflict: §9.3.2 distinguishes transaction files from relationship files, whereas regulation 13(2)(b) covers supporting evidence and records necessary to reconstruct all transactions. Whether a particular document falls in both descriptions, and how the guidance's clock interacts with regulation 13(2)(b) for that document, is not resolved here; do not shorten the statutory trigger without competent legal review. Paragraph (c) starts the clock for disclosures, internal reports and written determinations on the later of relationship end/transaction or report submission/determination. Paragraph (d) starts the training-record clock when the training event occurs. The first proviso uses the last operation for a linked series of occasional transactions; the second permits a justified, necessary and proportionate extension up to a total maximum of ten years. FIAU Part I §§9.3.1-9.3.8 distinguish relationship-specific CRAs, relationship/transaction files, internal reports and non-disclosure decisions, STR copies and supporting records, training, employee screening, outsourcing/reliance and other records. Regulation 13(1)(g) covers additional records FIAU may require under regulation 17; each applicable direction needs its own verified trigger. For crypto activity, retained Part II §3.9 lists transaction details and points back to Part I Chapter 9; public-ledger availability does not replace the firm's own file. The official ELI consolidation incorporates L.N. 82 of 2026, whose checked clauses do not amend reg. 13; any later PMLFTR amendment, sector applicability, other legal holds and data-protection duties remain open. This is not an approved retention schedule.

PMLFTR regs. 21-24 concern administrative penalties, not recordkeeping.

Official ELI consolidation dated 1 April 2026. Its first page identifies L.N. 372/2017 as amended by L.N. 430/2018, 77/2019, 26/2020, 214/2020, 199/2021, 313/2021, 379/2024 and 82/2026. The official ELI relation list and consolidation were checked on 29 September 2026; later amendment completeness beyond the page checked and other aspects of current legal application remain subject to revalidation.
The official Maltese PDF was retrieved from its ELI record and fingerprinted. Its first page states the complete instrument/amendment chain. Exact record-retention provisions are reg. 13(1)(a)-(g), reg. 13(2)(a)-(d), both provisos, and regs. 13(3)-(7). This custody evidence does not establish legal completeness, requirements, or activity applicability.
