Why it matters

RegCanary's analysis of what this means for regulated firms.

The proposals would bring two new permitted activities — member referral arrangements and loan participation — inside a proportionate prudential framework, rather than leaving them unaddressed as the statutory basis changes. For compliance and risk teams at affected credit unions, the practical consequence is that growth ambitions must be matched by demonstrable risk management. Boards should expect scrutiny of how referred members are onboarded, how counterparty and credit risk on participated loans is assessed, and how governance, policies and capital planning are updated before any new activity is undertaken.

Firms that treat this as a documentation exercise are likely to find themselves behind peers who embed the expectations in their lending and third-party oversight frameworks early. The consultation closes on 12 January 2027, giving ample time for considered engagement — but internal scoping should not wait. Recommended actions: map current and planned activities against the new permissions; assess whether existing policies, MI and systems can support referral and participation activity; identify any capital or liquidity implications; and consider responding to the consultation, individually or through a trade body, to shape proportionality for smaller institutions.

Broader read-across: while the scope is confined to Northern Ireland, the direction of travel — enabling diversification with corresponding prudential guardrails — will be familiar to credit unions and mutuals across the UK. Sector-adjacent lenders and partners considering referral or participation arrangements with NICUs should monitor the final rules.
