Coverage and gaps

The collected register and the retail-bank journey are different scopes. Outstanding work is shown here once; it is not silently treated as completed coverage.

Full scope statement

The register accounts for 20 retained instruments covering FICA, reporting Regulations and their separate July 2026 amendment, FIC employee screening, reporting-failure mitigation, beneficial ownership and crypto-asset transfers, Prudential Authority bank guidance, POCA and the separately retained POCDATARA base Act, 2022 amendment and commencement notice. Every extracted unit in these instruments has a processing disposition. Only independently reviewed explanations are readable; unresolved analysis remains withheld at its exact provision. The individual retail-bank journey connects selected evidence to bank readiness, customer identification, risk, opening decisions, monitoring, reporting and retention. Crypto-transfer and correspondent-bank rules apply only to their stated activities, not automatically to every retail account. Binding legislation and directives remain distinct from supervisory guidance and RegCanary's implementation explanation. The retained editions and amendment history are visible per instrument. This is dated financial-crime coverage, not a bank-licensing checklist or a claim that all current South African banking law has been analysed.

Analysis to finish 3

  • Collected, analysis outstanding: the Prudential Authority's December 2025 banking-sector risk assessment and Communication 1 of 2025; the 2022 bank risk-return workbook cells are also retained but their explanations remain unpublished
  • Item-by-item analysis of Schedule 2 (supervisory bodies) and Schedules 3A to 3C (domestic and foreign politically exposed persons and prominent influential persons): each schedule is recorded as one provision
  • The apparent printed offence-wording defect in the 2026 amendment's clause 7: source custody is verified, but its legal interpretation remains unresolved and unpublished

Source retrieval and currentness 5

  • Source retrieval outstanding: the original FSCA Communication 44 of 2024 on the crypto-asset travel rule could not be retained; Directive 9 itself is included, with its activity-specific scope
  • Source-register reconciliation outstanding: other FIC communications and guidance from the FSCA and other supervisory bodies are not claimed as fully collected or analysed
  • A fully reconciled current Regulations consolidation: the 1 February 2023 baseline and the 1 July 2026 amendment are retained separately; remaining intervening or later amendments require reconciliation
  • Any amendment to FICA not shown in the Financial Intelligence Centre's October 2023 consolidation used here: that consolidation carries the 2022 amendments (sections 26A to 26C on targeted financial sanctions, section 28A on property reporting and the crypto asset service provider entry in Schedule 1), but later changes should be checked against the Government Gazette
  • Schedule 3C's operative transaction-value notice and any later postponement: the 2022 commencement evidence and Guidance Note 7B's envisaged-delay statement need reconciliation; no threshold is invented

Outside this retail-account scenario 2

  • Outside the ordinary bank activity: final FIC Directives 10, 11 and 12 are retained; their application clauses omit Schedule 1 item 6 and the latter two expressly exclude banks in their item-11 population. Separately listed activities still require analysis before those rules are assigned
  • Bank authorisation, prudential and conduct permissions, deposit/product law, exchange controls, privacy and customer-notice rules are outside this AML retail-account journey
