Obliged institutions also apply customer due diligence measures to customers with whom they maintain a business relationship, taking into account the identified money laundering and terrorist financing risk, in particular where: 1) the previously established nature or circumstances of the business relationship have changed; 2) the previously established data concerning the customer or beneficial owner have changed; 3) the obliged institution was, in the given calendar year, required by law to contact the customer in order to verify information on beneficial owners, in particular where that requirement arose under the Act of 9 March 2017 on the exchange of tax information with other countries (Journal of Laws of 2024, items 1588 and 1685). 3. A condition for access to anonymous safe-deposit boxes is the obliged institution's application of the customer due diligence measures referred to in Art. 34.

Plain English

Sets when CDD must be applied: on establishing a business relationship; on an occasional transaction of EUR 15,000 or more (single or linked), a funds transfer over EUR 1,000, or, for virtual-currency providers, a virtual-currency transaction of EUR 1,000 or more; on cash transactions of EUR 10,000 or more for foundations, associations and traders in goods; on stakes or winnings of EUR 2,000 or more for gambling operators; on any suspicion of ML/TF; and on doubt about identification data already held. CDD must also be reapplied, on a risk basis, to existing customers when the nature or circumstances of the relationship or the customer or beneficial-owner data change, or when the institution was legally required that year to contact the customer to verify beneficial-owner information (for example under the tax-information exchange Act). Access to an anonymous safe-deposit box requires CDD first.

Obligation

Apply CDD on relationship establishment and on the stated occasional-transaction/cash/stake thresholds, on any ML/TF suspicion, on doubt about held data, and refresh CDD on existing relationships when circumstances or customer/beneficial-owner data change or an annual verification duty is triggered.

1. Obliged institutions, taking into account the identified money laundering and terrorist financing risk, may waive applying the customer due diligence measures referred to in Art. 34(1)(1)-(3) in respect of electronic money within the meaning of the Act of 19 August 2011 on payment services, provided the following risk-limiting conditions are met: 1) the payment instrument cannot be reloaded, or that instrument has a maximum monthly payment-transaction limit of the equivalent of EUR 150, which amount may be used only in the territory of the Republic of Poland; 2) the maximum amount stored electronically does not exceed the equivalent of EUR 150; 3) the payment instrument may be used only to purchase goods or services; 4) the payment instrument cannot be loaded with electronic money issued without customer due diligence measures having been applied; 5) the electronic money issuer carries out ongoing analysis of the transactions performed or monitors the business relationship in a manner enabling the identification of unusual transactions, or transactions whose circumstances indicate that they may be connected with money laundering or terrorist financing. 2. Paragraph 1 does not apply in the case of: 1) redemption of electronic money or withdrawal in cash of the electronic money's value, where the amount to be redeemed or withdrawn in cash exceeds the equivalent of EUR 50; 2) where the payment transaction is initiated via the internet or a device that can be used for remote communication, and where the amount of a single transaction exceeds the equivalent of EUR 50. 3. Plain English

Lets an e-money issuer, where its risk assessment allows, skip customer identification, verification and relationship assessment for electronic money if all five conditions hold: the instrument cannot be reloaded, or has a EUR 150 monthly limit usable only in Poland; no more than EUR 150 is stored; it can be used only to buy goods or services; it cannot be loaded with e-money issued without CDD; and the issuer monitors transactions well enough to spot unusual or suspicious ones. The waiver does not cover redemption or cash withdrawal over EUR 50, or remotely initiated payments over EUR 50. Card schemes must make it possible to confirm whether a third-country anonymous prepaid card meets these limits, and settlement agents must not accept payments by such cards that do not.

Obligation

Settlement agents must refuse payments made with third-country anonymous prepaid cards that do not meet the ust. 1-2 limits. An e-money issuer that waives identification, verification and relationship assessment must stay within all five ust. 1 conditions and apply CDD for redemptions, cash withdrawals and remote transactions over EUR 50.

Such entities, on request of the obliged institution applying customer due diligence measures to them, make available information or documents allowing identification of their beneficial owners. 2. Verification of the identity of the customer and the beneficial owner may be completed during the establishment of the business relationship, where this is necessary to ensure the continuity of business activity and where there is a low risk of money laundering or terrorist financing. 1.

1. Obliged institutions that are part of a group, and their branches and subsidiaries with a majority holding by those institutions established in a third country, introduce a group-wide anti-money-laundering and counter-terrorist-financing procedure, hereinafter referred to as the "group procedure", in order to perform the duties on the group and the entities belonging to it set out in the provisions on counteracting money laundering and terrorist financing. 2. The group procedure sets out the rules for exchanging and protecting information provided for the purposes of performing anti-money-laundering and counter-terrorist-financing duties between the individual entities belonging to the group. 3. Where the anti-money-laundering or counter-terrorist-financing requirements applicable in a third country are less stringent than those under the Act, obliged institutions require their branches and subsidiaries with a majority holding by those institutions established in that third country to apply the Act's provisions, including on personal data protection, to the extent permitted by the law of that country. 4. Where the law of a third country does not permit implementation of the group procedure in branches of obliged institutions and subsidiaries with a majority holding by those institutions established in that country, obliged institutions ensure that those branches and subsidiaries apply additional measures to effectively counteract money laundering and terrorist financing, and inform the General Inspector and the authorities referred to in Art. 130(2) competent for the obliged institution as regards control or supervision. Where the authorities referred to in Art. 130, including as a result of an inspection, find that the additional measures applied are insufficient to effectively counteract money laundering or terrorist financing, they take appropriate action, including prohibiting the establishment of business relationships or ordering their termination, prohibiting the carrying out of transactions, and, where necessary, ordering the cessation of business in the third country. 5. The General Inspector informs the European Supervisory Authorities of cases where the law of a third country does not permit implementation of the group procedure. In assessing the reasons for the failure to implement the group procedure, the General Inspector takes into account the legal restrictions that may stand in the way of properly implementing the group procedure, including the duty of confidentiality, data protection, and other restrictions that may be relevant for the exchange of information.

Plain English

Requires group-level obliged institutions and their third-country branches/majority-owned subsidiaries to run a group-wide AML/CTF procedure covering information exchange/protection; requires the stricter of Polish or local rules to be applied abroad; requires additional safeguards plus a GIIF/supervisor notification where local law blocks the group procedure, with escalation (restriction, termination orders, or ordering the overseas business to stop) if the authorities find the additional safeguards insufficient; and requires the GIIF to inform the European Supervisory Authorities of blocked cases.

Obligation

Run a group-wide AML/CTF procedure across group members and third-country branches/subsidiaries; apply the stricter of local/Polish rules abroad; apply and report additional safeguards, and comply with any resulting restriction/termination order, where local law blocks the group procedure.
