Every provision of these instruments is accounted for: each has a disposition (obligation mapped, contextual, outside scope, superseded, future or unresolved), and each mapped obligation has an independently reviewed plain-English explanation. The shared Regulation (EU) 2024/1624 adds 96 reviewed units from its English Official Journal edition. Its firm duties generally apply from 10 July 2027, with the Article 3(3)(n)/(o) football-entity exception from 10 July 2029; they are not current national duties. Institutional deadlines do not establish later acts were issued or national options exercised. Other EU instruments remain outside this shared package.

Article 3 1. An institution performs customer due diligence to prevent money laundering and terrorist financing. 2. The customer due diligence enables the institution to: a. identify the client and verify their identity; b. identify the client's ultimate beneficial owner and take reasonable measures to verify their identity, where the client is a legal person, take reasonable measures to gain insight into the client's ownership and control structure, and, where the ultimate beneficial owner is a member of senior management, take the necessary reasonable measures to verify the identity of the natural person who is a member of senior management, recording the measures taken and the difficulties encountered during the verification process; c. determine the purpose and intended nature of the business relationship; d. conduct ongoing monitoring of the business relationship and the transactions carried out during the course of that relationship, to ensure that these correspond with the institution's knowledge of the client and the client's risk profile, including, where necessary, an investigation into the source of the funds used in the business relationship or transaction; e. establish whether the natural person representing the client is authorised to do so and, where applicable, identify that natural person and verify their identity; f. take reasonable measures to verify whether the client is acting on their own behalf or on behalf of a third party. 3. Where a client acts as trustee of a trust or for the benefit of another legal arrangement, the customer due diligence referred to in the first paragraph also extends to the trust or legal arrangement, applying the measures referred to in the second paragraph correspondingly. In that case the customer due diligence also enables the institution to establish whether the client is authorised to act as trustee of a trust or for the benefit of another legal arrangement. If, when entering into a business relationship or carrying out an incidental transaction above the thresholds referred to in Article 3, fifth paragraph, points (b) and (g), sixth or seventh paragraph, a client acts in the capacity of trustee, the client promptly informs the institution of that capacity and provides the institution with the data and documents referred to in Article 5 of the Implementation Act on the Registration of Ultimate Beneficial Owners of Trusts and Similar Legal Arrangements. 4. Where a client acts as a partner of a partnership, the customer due diligence referred to in the first paragraph also extends to the partnership, applying the measures referred to in the second paragraph correspondingly. In that case the customer due diligence also enables the institution to establish whether the natural person representing the partners in the partnership is authorised to do so and, where applicable, to identify that person and verify their identity. 5. An institution performs customer due diligence in the following cases: a. where it enters into a business relationship in or from the Netherlands; b. where it carries out, in or from the Netherlands, an incidental transaction for the client of at least €15,000, or two or more transactions between which a link exists with a combined value of at least €15,000; c. where there are indications that the client is involved in money laundering or terrorist financing; d. where it doubts the accuracy or completeness of data previously obtained from the client; e. where the risk of an existing client's involvement in money laundering or terrorist financing gives cause to do so; f. where, given the state in which a client resides, is established or has its seat, there is an increased risk of money laundering or terrorist financing; g. where it carries out, in or from the Netherlands, an incidental transaction for the client or the trust, comprising a transfer of funds referred to in Article 3(9) of the Regulation on information accompanying transfers of funds and transfers of crypto-assets, of an amount of at least €1,000. 6. By way of derogation from the fifth paragraph, point (b), an institution referred to in Article 1a, fourth paragraph, point (l), performs customer due diligence where it carries out, in or from the Netherlands, an incidental transaction for the client of at least €2,000 when collecting winnings or placing a bet, or two or more linked transactions with a combined value of at least €2,000. 7. An institution demonstrably tailors the customer due diligence to the money-laundering or terrorist-financing risk sensitivity of the type of client, business relationship, product or transaction. 8. In determining the risk sensitivity referred to in the seventh paragraph, an institution at least takes into account the risk variables listed in Annex I to the Fourth Anti-Money Laundering Directive. 9. The first to eighth and tenth paragraphs do not apply to an institution referred to in Article 1a, fourth paragraph, point (m). 10. An institution takes reasonable measures to ensure that the data collected under the second to fourth paragraphs about the persons referred to there are kept up to date. The data are in any event updated where relevant circumstances of the client change, where an institution is obliged under this Act to contact the client to evaluate information concerning the ultimate beneficiary, or where the institution is obliged to do so under Council Directive 2011/16/EU of 15 February 2011 on administrative cooperation in the field of taxation and repealing Directive 77/79/EEC [sic; so in the Dutch text] (OJ EU 2011, L 64). 11. In this Article, partnership means a maatschap as referred to in Article 1655 of Book 7A of the Civil Code, a general partnership (vennootschap onder firma) as referred to in Article 16 of the Commercial Code, and a limited partnership (commanditaire vennootschap) as referred to in Article 19 of the Commercial Code, as well as a partnership or company under foreign law comparable to one of these legal forms. 12. For the purposes of the second paragraph, where the obligation referred to in the first paragraph rests on an intermediary referred to in Article 1a, fourth paragraph, point (h), client also includes the counterparty of the client in an agreement concerning immovable property and rights to which immovable property is subject, brought about and concluded through the intermediary's mediation. 13. In the case of a trust office referred to in Article 1a, fourth paragraph, point (f), that provides services referred to in the definition of trust service in Article 1(1) of the Trust Offices (Supervision) Act 2018: a. customer due diligence within the meaning of the first paragraph means the measures prescribed under Chapter 4 of the Trust Offices (Supervision) Act 2018 that are carried out before or when providing a service or entering into a business relationship; b. the second to eighth and tenth paragraphs do not apply. 14. Lapsed through renumbering. 15. When performing customer due diligence, institutions do not rely exclusively on the information in the trade register referred to in Article 2 of the Trade Register Act 2007, or the information in the register referred to in Article 4 of the Implementation Act on the Registration of Ultimate Beneficial Owners of Trusts and Similar Legal Arrangements.

Plain English

Article 3 is the Wwft's core CDD provision. It requires identifying and verifying the client, identifying the UBO and taking reasonable verification/ownership-structure measures (with extra steps where the UBO is senior management), establishing the purpose and intended nature of the relationship, ongoing monitoring (including source-of-funds checks where needed), checking representative authority/identity, and checking whether the client acts for itself or a third party. CDD extends to the underlying trust/legal arrangement or partnership where the client acts as trustee or partner. CDD must be performed on entering a business relationship, on incidental transactions of €15,000+ (or linked transactions reaching that total), on suspicion indicators, on doubts about earlier data, on increased risk from an existing client or high-risk country, and on incidental transfers of funds (Article 3(9) of Regulation (EU) 2023/1113) of €1,000 or more; gaming providers use a €2,000 threshold instead of €15,000. CDD must be risk-sensitised using at least the Annex I risk variables of the Fourth AML Directive. Property valuers (Article 1a(4)(m)) are excluded from most of this article. CDD data must be kept up to date, with specific refresh triggers. Trust offices apply their own Wtt 2018 Chapter 4 CDD regime instead. Institutions may not rely solely on the trade register or UBO register when performing CDD.

Obligation

Perform risk-sensitised customer due diligence (identification, verification, UBO identification, purpose/nature, ongoing monitoring, representative checks, own-account/third-party checks) on the listed triggers, extending to trusts/legal arrangements/partnerships where relevant, and keep the data current; do not rely solely on the trade register or UBO register.

An institution may not enter into a business relationship or carry out a transaction unless CDD under Article 3 has been carried out, by itself or (in accordance with Article 3 or equivalently) by: a tax adviser, accountant, lawyer, notary or comparable legal professional based in the Netherlands or another Member State; a licensed trust office; a bank or other financial undertaking, or its branch, in the Netherlands or another Member State; such an institution in a third country designated by the Minister of Finance as having equivalent, supervised rules; or a group branch or majority subsidiary in a third country that fully applies the group policies. The CDD must have produced the Article 3(2) results (identity, UBO, purpose and nature, representation, own-account check, and the trust and partnership extensions), and the institution must hold all identification and verification data. The supervisor may allow reliance through group policies on conditions. Where CDD cannot be completed for a business relationship, the institution must end it. Paragraphs 1-3 do not apply in the Article 6-7 cases. Banks and other financial undertakings may not enter into or continue a correspondent relationship with a shell bank or with an institution known to let a shell bank use its accounts.

Obligation

Do not deal with a client absent completed (own or qualifying third-party/group) CDD producing the required result and data; terminate a relationship where CDD cannot be completed; never enter or continue a correspondent relationship with a shell bank or an enabler of one.

Article 6 1. By way of derogation from Article 3, second to fourth paragraphs, an institution may carry out simplified customer due diligence if a business relationship or transaction by its nature presents a low risk of money laundering or terrorist financing. In doing so the institution at least takes into account the risk factors listed in Annex II to the Fourth Anti-Money Laundering Directive. 2. An institution demonstrably collects sufficient data to be able to establish whether simplified customer due diligence as referred to in the first paragraph can be carried out in respect of a client. 3. An institution takes reasonable measures to ensure that the data collected under the second paragraph, and the determination based on it, are kept up to date. 4. An institution ensures adequate monitoring of the transactions or the business relationship to ensure that it can comply with Article 16.

Plain English

Allows simplified CDD for genuinely low-risk relationships/transactions, assessed against at least the Annex II risk factors, but the institution must demonstrably justify and document the low-risk finding, keep that finding current, and still monitor adequately enough to be able to file unusual-transaction reports under Article 16.

Obligation

May apply simplified CDD only where demonstrably low-risk per Annex II factors, with the determination documented, kept current, and backed by adequate ongoing monitoring sufficient for Article 16 reporting.

Article 8 1. In addition to Article 3, second to fourth paragraphs, an institution carries out enhanced customer due diligence in at least the following cases: a. where the business relationship or transaction by its nature presents a higher risk of money laundering or terrorist financing; b. where the state in which the client resides, is established or has its seat is designated by the European Commission under Article 9 of the Fourth Anti-Money Laundering Directive as a state presenting a higher risk of money laundering or terrorist financing. 2. An institution at least takes into account the risk factors in Annex III to the Fourth Anti-Money Laundering Directive to establish whether the first paragraph, point (a), applies. 3. An institution takes reasonable measures to examine the background and purpose of complex or unusually large transactions, transactions with an unusual pattern or without a clear economic or lawful purpose, and in that case subjects the entire business relationship with the client to enhanced monitoring. 4. Without prejudice to the first paragraph, a bank or other financial undertaking entering into or having entered into a correspondent relationship with a respondent institution in a state that is not a Member State, involving payments, ensures, on entering into the business relationship, that: a. it gathers sufficient information about the respondent institution to fully understand the nature of its business and assesses, based on publicly available information, the respondent institution's reputation and the quality of supervision to which it is subject; b. it assesses the respondent institution's anti-money laundering and terrorist financing controls and procedures; c. for a new correspondent relationship, the decision to enter into it is taken or approved by the senior management of the bank or other financial undertaking; d. the respective responsibilities of the bank or other financial undertaking and of the respondent institution are documented; e. the respondent institution has identified and verified the identity of customers with direct access to payable-through accounts, exercises ongoing monitoring of those customers, and is able to provide relevant customer data on request; f. where a correspondent relationship is terminated for reasons connected with money laundering or terrorist financing, the decision is documented. 5. In addition to the customer due diligence measures referred to in Article 3, crypto-asset service providers, for transfers of crypto-assets to or from a self-hosted address, ensure that: a. they have internal policies, procedures and controls to identify and assess the risk of money laundering and terrorist financing; b. risk-mitigating measures proportionate to the identified risks are taken, being one or more of: 1°. risk-based measures to identify and verify the identity of the originator or beneficiary of a transfer to or from a self-hosted address, or of the ultimate beneficial owner of the originator or beneficiary, including by relying on third parties; 2°. requiring additional information on the origin and destination of the transferred crypto-assets; 3°. tightening ongoing monitoring of these transactions; 4°. any other measures to mitigate and manage the risks of money laundering and terrorist financing as well as the risk of non-implementation and evasion of targeted financial sanctions and targeted financial sanctions related to proliferation financing. 6. In addition to the customer due diligence measures referred to in Article 3: a. an institution has adequate risk-management systems, including risk-based procedures, to determine whether the client or the ultimate beneficial owner is a politically exposed person; b. an institution applies the following measures when entering into or continuing a business relationship with, or carrying out a transaction for, a politically exposed person: 1°. entering into or continuing the business relationship or carrying out the transaction requires the approval of a member of senior management; 2°. appropriate measures are taken to establish the source of wealth and of the funds used in that business relationship or transaction; 3°. the business relationship is subjected to ongoing enhanced monitoring. 7. In addition to the customer due diligence measures referred to in Article 3: a. an institution takes reasonable measures, no later than at payout of the policy or at full or partial transfer of the policy, to determine whether the beneficiary or the ultimate beneficial owner of the beneficiary of a life insurance policy is a politically exposed person; b. an institution applies the following measures where the person referred to under (a) is a politically exposed person: 1°. a member of senior management is informed of the payout of the policy proceeds to the persons referred to under (a), before that payout; 2°. the entire business relationship with the policyholder is subjected to enhanced monitoring. 8. If the client or the ultimate beneficial owner no longer holds a prominent public function, the institution applies appropriate risk-based measures for as long as necessary, but for at least 12 months, until that person no longer presents the higher risk associated with politically exposed persons. 9. The measures referred to in the fifth to seventh paragraphs apply correspondingly to family members of politically exposed persons and persons known to be close associates of politically exposed persons. 10. If the client or the ultimate beneficial owner becomes or is found to be a politically exposed person during the business relationship, the institution complies without delay, after this becomes apparent, with the sixth paragraph, the seventh paragraph point (b), and the eighth and ninth paragraphs. 11. If a client is a branch or majority-owned subsidiary, established or with its seat in a state referred to in the first paragraph, of an institution established in a Member State, and that branch or majority-owned subsidiary fully complies with the group-level policies and procedures in accordance with Article 2f, second paragraph, customer due diligence tailored to the money laundering or terrorist financing risks associated with that client may be carried out instead of enhanced customer due diligence. 12. An institution takes reasonable measures to ensure that the data collected under the third to seventh, ninth and eleventh paragraphs are kept up to date.

Plain English

Mandates enhanced due diligence for inherently higher-risk relationships/transactions and for Commission-designated high-risk third countries, assessed against Annex III factors; requires investigation of complex/unusual/no-clear-purpose transactions with enhanced monitoring of the whole relationship; imposes detailed correspondent-banking EDD for non-EEA respondent banks (background checks, AML-control assessment, senior sign-off, documented responsibilities, confirmation the respondent itself identifies payable-through-account users, documented exit decisions); requires crypto-asset service providers to run risk-based controls on self-hosted-address transfers (identity/UBO verification, extra origin/destination information, tighter monitoring, sanctions-evasion safeguards); sets the standard PEP regime (senior approval, source-of-wealth/funds checks, ongoing enhanced monitoring, appropriate risk-based measures for at least 12 months after a PEP leaves office) extended to PEP family members/close associates, with a specific life-insurance-beneficiary PEP check at payout/transfer; allows calibrated (not full EDD) treatment for compliant group branches/subsidiaries in high-risk states; requires keeping the underlying data current.

Obligation

Carry out enhanced due diligence for higher-risk relationships/transactions, Commission-designated high-risk countries, PEPs (and family/close associates) and correspondent banking with non-EEA respondents, and risk-based EDD for crypto-asset self-hosted-address transfers, per the detailed measures set out.

Translation (Machine translation, unofficial)

Article 16 1. An institution reports a completed or proposed unusual transaction to the Financial Intelligence Unit without delay after the unusual nature of the transaction has become known. 2. In a report referred to in the first paragraph, the institution provides the following data: a. the identity of the client, the identity of the ultimate beneficial owners and, as far as possible, the identity of the person on whose behalf the transaction is carried out; b. the type and number of the client's identity document and, as far as possible, of the other persons referred to under (a); c. the nature, time and place of the transaction; d. the amount and the destination and origin of the funds, securities, precious metals or other valuables involved in the transaction; e. the circumstances on the basis of which the transaction is regarded as unusual; f. a description of the relevant high-value items in a transaction above €10,000; g. additional data to be designated by general administrative order. 3. By way of derogation from the second paragraph, an institution referred to in Article 1a, fourth paragraph, point (m), provides the data referred to in the second paragraph insofar as it has that data, as well as a description of the relevant immovable property and rights to which immovable property is subject. 4. The reporting obligation referred to in the first paragraph applies correspondingly where: a. customer due diligence referred to in Article 3, first paragraph, does not lead to the result referred to in Article 5, first paragraph, point (b), or to the implementation of the measures referred to in Article 3, fourteenth paragraph, point (a), and there are also indications that the client concerned is involved in money laundering or terrorist financing; b. a business relationship is terminated under Article 5, third paragraph, and there are also indications that the client concerned is involved in money laundering or terrorist financing. 5. When reporting under the fourth paragraph, an institution provides, in addition to the data referred to in the second paragraph, a description of the reasons why the fourth paragraph applies.

Plain English

The core reporting obligation: an institution must report a completed or proposed unusual transaction to the FIU without delay once its unusual nature is recognised, supplying client/UBO/transacting-party identity, ID document details, transaction nature/time/place, amount and origin/destination of funds, the grounds for unusualness, a description of high-value items above €10,000, and any further data required by lower-level rules. Property valuers report only what they hold, plus a property description. The duty also applies where CDD fails to clear the client and there are ML/TF indications, or where a relationship is terminated under Article 5(3) with such indications, in which case the institution also explains why. The unusual-transaction indicators are in Annex 1 to the Uitvoeringsbesluit Wwft 2018. Note: paragraph 4(a) still refers to the measures in "Article 3, fourteenth paragraph, point (a)", but Article 3(14) now reads "Door vernummering vervallen" (lapsed through renumbering), so that cross-reference is out of date in the consolidated text.

Obligation

Report completed or proposed unusual transactions to the FIU without delay, with the specified client, UBO, transaction and valuables data, including on failed-CDD and relationship-termination triggers.
