Original text (Finnish)

Ilmoitusvelvollisen on laadittava riskiarvio rahanpesun ja terrorismin rahoittamisen riskien tunnistamiseksi ja arvioimiseksi. Riskiarvio on päivitettävä säännöllisesti.

Translation (Machine translation, unofficial)

An obliged entity must prepare a risk assessment to identify and assess its money-laundering and terrorist-financing risks. The risk assessment must be updated regularly. The risk assessment and any changes made to it must be supplied to the competent supervisory authority or the Bar Association on its request, without undue delay. The obliged entity must take into account, when preparing the risk assessment, the nature, size and scale of its activity. Taking the foregoing factors into account, the obliged entity must have adequate policies, procedures and controls to reduce and effectively manage money-laundering and terrorist-financing risks. The policies, procedures and controls must include at least: (1) the development of internal policies, procedures and controls; (2) internal audit, where this is justified having regard to the nature and size of the obliged entity's activity. The obliged entity must draw up the policies, procedures and controls referred to in subsection 2, and must monitor and develop the measures connected with them. Where the obliged entity is a legal person, the board, the general partner or another person in an equivalent senior-management position must approve the policies, procedures and controls referred to in subsection 2, and must monitor and develop the measures connected with them. The central institution referred to in the Act on Amalgamations of Deposit Banks (599/2010) may prepare the risk assessment on behalf of a member credit institution of the amalgamation, if the Financial Supervisory Authority grants permission.

Plain English

Every obliged entity must itself prepare and keep updated a risk assessment identifying its own money-laundering and terrorist-financing risks, taking its nature, size and scale into account, and must back it with adequate policies, procedures and controls, covering at minimum the development of internal policies/procedures/controls and (where justified by the entity's nature and size) internal audit; senior management must approve these and keep them under review, and the assessment must be supplied to the supervisor or Bar Association on request without undue delay. A central institution of a deposit-bank amalgamation may prepare the risk assessment on behalf of a member credit institution if the Financial Supervisory Authority permits it.

Obligation

Prepare and keep up to date a firm-level money-laundering/terrorist-financing risk assessment, and maintain adequate risk-based policies, procedures and internal controls (including internal audit where justified), approved and kept under review by senior management.

Where an obliged entity is unable to carry out the customer due diligence measures required by this chapter, the obliged entity must not establish a business relationship, carry out a transaction, or maintain a business relationship. Where the obliged entity is a credit institution, it must also not carry out a payment transaction through a payment account if it is unable to carry out the measures required for customer due diligence. The obliged entity must also assess whether it is necessary to make a suspicious-transaction report in the case. The obliged entity must suspend its customer due diligence measures if it reasonably assesses that continuing those measures would jeopardise the making of a suspicious-transaction report. In assessing the money-laundering and terrorist-financing risks relating to a customer relationship, the obliged entity must take into account the money-laundering and terrorist-financing risks relating to new and existing customers, to countries or geographic areas, and to new, developing and existing products, services, transactions, distribution channels and technologies (risk-based assessment). The customer due diligence measures laid down in this chapter must be complied with, on the basis of the risk-based assessment, throughout the business relationship. The obliged entity must also comply with the customer due diligence provisions where it has or has had a statutory duty, under the Act on the National Implementation of the Provisions Falling within the Scope of Legislation of the Council Directive on Administrative Cooperation in the Field of Taxation and Repealing Directive 77/799/EEC and on the Application of the Directive (185/2013), or under other regulation laying down a corresponding obligation, to contact the customer during a calendar year to verify relevant information on the beneficial owner. The obliged entity must be able to demonstrate to the supervisory authority or to the entity placed under supervision that the methods it applies under this Act for customer due diligence and ongoing monitoring are adequate for the money-laundering and terrorist-financing risk.

Plain English

An obliged entity that cannot carry out the customer due diligence measures required by this chapter must not establish the business relationship, carry out the transaction, or maintain the business relationship; a credit institution must additionally refuse a payment transaction through a payment account on the same basis. The entity must also assess whether the case warrants a suspicious-transaction report, and must pause due-diligence steps if continuing them would risk tipping off the customer to an intended report. Due diligence must be risk-based (new and existing customers, countries/geographic areas, products/services/channels/technologies) and applied throughout the relationship, including where the entity is separately obliged periodically to re-verify beneficial-ownership data under tax-cooperation legislation; the entity must be able to demonstrate to its supervisor that its methods are adequate for the risk.

Obligation

Refuse to establish or must terminate a customer relationship/transaction (and a credit institution must refuse a payment transaction) where required customer due diligence cannot be completed; apply risk-based CDD throughout the relationship and be able to demonstrate adequacy to the supervisor.

(28.6.2024/414)

Translation (Machine translation, unofficial)

Except for the exceptions provided in this section, an obliged entity must not hold anonymous accounts or customer relationships, or accounts or customer relationships in fictitious names. The obliged entity must identify its customer and verify that customer's identity when establishing a permanent customer relationship. In addition, the obliged entity must identify its customer and verify that customer's identity if: (1) the customer relationship is occasional and: (a) the amount of the transaction, or the aggregate amount of linked transactions, is at least EUR 10,000; (b) it concerns a transfer of funds referred to in Article 3(9) of the Funds Transfer Regulation exceeding EUR 1,000; or (c) it concerns a transaction in a crypto-asset-related service referred to in the Act on Providers of Crypto-Asset Services and Crypto-Asset Markets (402/2024) exceeding EUR 1,000; (2) in the sale of goods, the amount of the transaction carried out in cash, or the aggregate of linked transactions carried out in cash, is at least EUR 10,000 and the customer relationship is occasional; (3) it concerns a suspicious transaction; or (4) the obliged entity doubts the reliability or adequacy of identity-verification data previously obtained on a verified customer. Notwithstanding subsection 1(1) and (2), in gambling activity the customer must be identified and that customer's identity verified either when the stake is placed or when winnings are paid, or on both occasions, if the stake placed or winnings redeemed by the player, as a single payment or as linked payments, total at least EUR 2,000. If a person acts on behalf of a customer (an agent), the obliged entity must also identify and verify the identity of that agent, and confirm the agent's right to act on the customer's behalf. The obliged entity must identify its customer and verify that customer's identity when establishing the customer relationship, or at the latest before the customer gains control over the assets or other property involved in the transaction, or before the transaction is completed. Where a new customer relationship is established with a legal person or a foreign express trust referred to in chapter 6, the obliged entity must, when establishing the customer relationship, verify that the beneficial owner of that legal person or foreign express trust has been entered in the register referred to in that chapter. Where the duty to identify the customer and verify identity arises because, in the cases referred to in subsection 1(1), the aggregate value of individual transactions reaches at least EUR 10,000, the amount of a transfer of funds referred to in Article 3(9) of the Funds Transfer Regulation exceeds EUR 1,000, or, in the cases referred to in point (2), the aggregate value of individual transactions reaches at least EUR 10,000, or in the cases referred to in subsection 2, at least EUR 2,000, identity must be verified once that threshold is reached. Provisions on the duty to identify and verify identity are also laid down in the Funds Transfer Regulation.

Plain English

An obliged entity may not hold anonymous or fictitious-name accounts or customer relationships (except the narrow exceptions this section itself provides), and must identify the customer and verify identity when establishing a permanent customer relationship, and also for occasional customers where the transaction (or linked transactions) totals at least EUR 10,000, or is a transfer of funds under the Funds Transfer Regulation exceeding EUR 1,000, or a crypto-asset service transaction exceeding EUR 1,000; in the sale of goods where an occasional customer's transaction (or linked transactions) in cash totals at least EUR 10,000; for suspicious transactions; and where the entity doubts previously-verified identity data. For gambling, identification/verification is required at stake or payout (or both) once EUR 2,000 is reached in linked stakes/winnings. Where someone acts on the customer's behalf (an agent), that person's identity and authority must also be verified. Identification/verification must occur at relationship formation or, at the latest, before the customer gains control of the transaction's assets or the transaction is completed; for new relationships with entities/foreign express trusts covered by chapter 6, the entity must confirm the beneficial owner is entered in the relevant register.

Obligation

Identify the customer and verify identity (and, where someone acts for the customer, verify the agent's identity and authority) at the specified triggers and thresholds, and not hold anonymous or fictitious-name accounts.

An obliged entity must obtain information on the activity of its customer and of that customer's beneficial owner, on the nature and scale of the business, and on the grounds for use of the service or product. The obliged entity may make use of information available on the customer or the customer's beneficial owner from various data sources, in order to prepare and maintain the customer risk assessment, to prevent money laundering and terrorist financing, and to fulfil the reporting and enquiry duties laid down in this Act. The obliged entity must pay particular attention to the credibility and reliability of the data source. Provisions on the processing of personal data are laid down in Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter the Data Protection Regulation, and in the Data Protection Act (1050/2018). The obliged entity must arrange monitoring of the customer that is adequate in relation to the nature and scale of the customer's activity, the permanence and duration of the customer relationship, and the risks, to ensure that the customer's activity corresponds to the experience and knowledge the obliged entity has of the customer and the customer's activity. The obliged entity must pay particular attention to transactions that are unusual in structure or size, or in relation to the obliged entity's size or place of business. The same applies if transactions have no apparent economic purpose, or are inconsistent with the experience or knowledge the obliged entity has of the customer. Where necessary, the origin of the funds involved in a transaction must be established.

Plain English

It must set up ongoing monitoring proportionate to the customer's activity, the permanence/duration of the relationship and the risk, to confirm activity matches what the entity knows, paying particular attention to structurally or size-wise unusual transactions or ones unusual for the entity's size/location, and to transactions lacking obvious economic purpose or inconsistent with known customer facts; where needed, the origin of funds involved in a transaction must be established.

Obligation

Obtain information on the customer's and beneficial owner's business activity and the purpose of the product/service, and maintain ongoing monitoring proportionate to risk to confirm that customer activity matches what is known, escalating to establishing the origin of funds where needed.

A credit or financial institution must, in addition to what is otherwise provided in this chapter, establish, for life assurance and other investment insurance: (1) the name of the beneficiary, where that person is identified or named as beneficiary; (2) for beneficiaries designated in a manner other than under point (1), sufficiently identifying data on the beneficiaries to enable payment when it falls due. The identity of the beneficiary referred to in subsection 1 must be verified when the payment is made. A credit or financial institution must identify a third party to whom or for whose benefit a life or investment insurance policy is transferred, when the transfer is carried out, if the credit or financial institution was aware of the transfer. A credit or financial institution must ensure that it has adequate information on the beneficial owners of a foreign trust, or of a recipient of business services, so that it is able to establish its rights connected to the foreign trust or business services. A credit or financial institution must establish whether the beneficiary of a life or other investment insurance policy is a politically exposed person, no later than when the payment is made or the policy is transferred in whole or in part. If the policy or its beneficiary is connected to a higher than usual risk of money laundering or terrorist financing, the employee of the credit or financial institution must, in addition, notify the institution's management before the insurance benefit is paid, and must comply with the provisions on enhanced customer due diligence. The credit or financial institution must assess whether it is necessary to make a suspicious-transaction report.

Plain English

Credit and financial institutions have special identification duties for life/other investment insurance: establishing a named beneficiary's name, or (for beneficiaries designated by class/characteristics) enough data to pay out on maturity, with the beneficiary's identity verified at payout; identifying a third party to whom the policy is transferred, where the institution knew of the transfer; ensuring adequate knowledge of a foreign trust's or business-service recipient's beneficial owners; checking whether the beneficiary is a PEP by no later than payout or transfer; and, for higher-risk policies/beneficiaries, requiring staff to escalate to management before paying out and apply enhanced due diligence, and assessing whether a suspicious-transaction report is needed.

Obligation

Identify life/investment-insurance beneficiaries (and verify identity at payout), identify transferees, check PEP status by payout/transfer, and escalate higher-risk policies to management with enhanced due diligence before paying out.

An obliged entity must identify and maintain adequate, accurate and up-to-date data on the customer's beneficial owners, and must, where necessary, verify their identity. The beneficial owner of an entity must always be identified in the situations referred to in chapter 1, section 5(2)-(4) and section 7. In addition, the obliged entity must, in a manner and to an extent appropriate to the money-laundering and terrorist-financing risks relating to the customer, establish whether any other person exercises the control referred to in chapter 1, section 5(1) over the customer. The obliged entity must keep a record of the identification measures taken concerning the beneficial owner. The beneficial owner does not, however, need to be identified where the customer is a company whose securities are traded on a regulated market referred to in: (1) chapter 2, section 5 of the Securities Markets Act (746/2012); or (2) a regulated market outside the European Economic Area equivalent to the market referred to in point (1), and the company is subject to a disclosure obligation corresponding to that laid down in Directive 2014/65/EU of the European Parliament and of the Council on markets in financial instruments, amending Directive 2002/92/EC and Directive 2011/61/EU. Ilmoitusvelvollisen tulee 4 §:n 2 momentissa tarkoitetulla tavalla jatkuvasti seurata asiakassuhdetta, jossa asiakkaan tuntemista koskevia velvollisuuksia on suorittanut kolmas osapuoli. Ilmoitusvelvollinen ei vapaudu tämän lain mukaisista vastuista sillä perusteella, että ilmoitusvelvollisen puolesta asiakkaan tuntemista koskevat velvollisuudet on täyttänyt kolmas osapuoli.

The customer due diligence duties may be fulfilled on behalf of the obliged entity by another obliged entity referred to in chapter 1, section 2(1), or by a corresponding operator licensed or registered in another EEA state (a "third party"), if that operator is subject to customer due diligence and data-retention duties equivalent to those laid down in this Act, and compliance with them is supervised. The customer due diligence duties may also be fulfilled by a corresponding operator to the obliged entity that is licensed or registered outside the EEA, if it is subject to customer due diligence and data-retention duties equivalent to those laid down in this Act, and compliance is supervised. It is further required that the corresponding operator is established in a state whose money-laundering and terrorist-financing prevention and investigation system does not, in the Commission's assessment, pose a significant risk to the EU internal market. Notwithstanding subsections 1 and 2, an obliged entity may not accept the following as fulfilling its obligations: (1) a payment institution whose principal payment service is money remittance referred to in the Payment Institutions Act; (2) a natural or legal person referred to in section 7 or 7a of the Payment Institutions Act; nor (3) an undertaking carrying on currency exchange. The obliged entity must ensure that, before carrying out the transaction, it receives from the third party the data referred to in section 3(2)(1)-(7). The obliged entity must further ensure that all customer due diligence data is available to it, and that the third party supplies it to the obliged entity on request. The supervisory authority may deem the conditions laid down in this section concerning a third party to be met where: (1) the obliged entity receives the data from a third party belonging to the same group or other economic grouping as the obliged entity; (2) the group or other economic grouping applies internal group- or grouping-wide procedures, equivalent to the provisions of this Act, concerning the customer due diligence duty, retention of customer data, and the prevention and detection of money laundering and terrorist financing; (3) the supervisory authority of the home state of the parent undertaking of the group or other economic grouping supervises compliance with point (2); and (4) the group's or other economic grouping's procedures for preventing and detecting money laundering and terrorist financing adequately take into account risk management and risk mitigation in relation to states presenting a high risk of money laundering and terrorist financing. [As amended by Act 13/2026, in force from 1 July 2027:] In respect of gambling activity, the supervisory authority may deem that a licence holder referred to in chapter 1, section 2(1)(9), or a gambling operator referred to in point (10), as obliged entity, fulfils the conditions laid down in this section if the trader or entity referred to in chapter 1, section 2(2) acting on its behalf, which intermediates participation notices or payments for gambling, complies with the provisions of sections 1, 2 and 10 of this chapter on customer due diligence, and the licence holder or gambling operator receives the customer due diligence data and identity-verification data from that trader or entity without delay. The licence holder and the gambling operator must maintain data on the traders and entities referred to above, which must be made available to the supervisory authority on request. [Wording currently in force until then:] In respect of gambling activity, the supervisory authority may deem that a gambling operator, as obliged entity, fulfils the conditions laid down in this section if the trader or entity referred to in chapter 1, section 2(2) acting on its behalf, which intermediates participation notices and payments for gambling, complies with the provisions of sections 1, 2 and 10 of this chapter on customer due diligence, and if the gambling operator receives the customer due diligence data and identity-verification data from that trader or entity without delay. The gambling operator must maintain data on the traders and entities referred to above, which must be made available to the supervisory authority on request. The obliged entity must continuously monitor, in the manner referred to in section 4(2), a customer relationship in which a third party has performed the customer due diligence duties. The obliged entity is not released from its liability under this Act on the ground that a third party has fulfilled the customer due diligence duties on its behalf.

Plain English

Another obliged entity, or an equivalent licensed/registered EEA (or, under stricter conditions, non-EEA) operator subject to equivalent CDD and record-keeping duties, may perform CDD on the entity's behalf as a "third party" - but a payment institution mainly providing money remittance, certain natural/legal persons under the Payment Institutions Act, and currency exchangers may never be accepted as a third party. Before completing the transaction the entity must obtain the specified data items from the third party, ensure all CDD data is accessible to it and that the third party will supply it on request; a supervisor may treat intra-group reliance as meeting these conditions where specified safeguards exist. Gambling-specific delegation rules are also set, and the entity must still continuously monitor the relationship and remains fully liable even where a third party performed CDD on its behalf. For gambling, the 13/2026 wording (referring to licence holders under the new Gambling Act) only applies from 1 July 2027; until then the parallel wording referring to gambling operators applies.

Obligation

Before relying on a third party to perform customer due diligence, obtain the prescribed customer due diligence data from that third party, ensure the data remains accessible and will be supplied on request, never rely on specified high-risk payment/currency-exchange operators, and retain full liability and ongoing-monitoring duties regardless.

When applying sections 2-4 and 6, an obliged entity may follow a simplified procedure for customer due diligence if, on the basis of its risk assessment, it assesses that the customer relationship or individual transaction involves a low risk of money laundering or terrorist financing. The obliged entity must nevertheless monitor the customer relationship in the manner referred to in section 4(2) to detect unusual or suspicious transactions. The obliged entity may not apply the simplified customer due diligence procedure if it detects unusual or suspicious transactions. The Government shall issue a decree with more detailed provisions on customers, products, services, payment traffic, delivery channels or geographic risk factors that may involve a low risk of money laundering or terrorist financing, and on the procedures to be followed in those situations.

Plain English

Where its risk assessment shows a low money-laundering/terrorist-financing risk, an obliged entity may apply simplified due diligence to identification, data retention, information-gathering and beneficial-owner identification, but must still monitor the relationship to detect unusual or suspicious transactions, and may not apply simplified measures once it detects unusual or suspicious transactions. A government decree specifies the low-risk customers/products/services/payment-traffic/delivery-channels/geography and the applicable simplified procedures.

Obligation

May apply simplified customer due diligence only where the entity's own risk assessment shows low risk, but must still monitor for and immediately stop using simplified measures on detecting unusual or suspicious transactions.

If an obliged entity assesses, on the basis of its risk assessment, that the money-laundering and terrorist-financing risk relating to electronic money is low, the provisions of section 2 of this chapter on identification and verification of identity, section 3 on customer due diligence data and their retention, and section 4(1) on obtaining data on the customer, do not apply, provided the following risk-management conditions are met: (1) the electronic storage medium is not reloadable, or electronic money referred to in the Payment Institutions Act can be loaded onto it up to at most EUR 150 per month, and the instrument can be used only in Finland; (2) at most EUR 150 can be loaded onto the electronic storage medium, and it can be used only in Finland; (3) the electronic storage medium can be used only to purchase goods or services; (4) the electronic storage medium cannot be loaded with anonymous electronic money; (5) the issuer of the electronic storage medium has adequate monitoring methods in place to detect unusual or suspicious transactions; (6) at most EUR 50 can be redeemed in cash from the electronic storage medium, or, in the case of a remote payment transaction, the amount paid is at most EUR 50 per transaction. A credit or financial institution may accept a payment made with an anonymous electronic storage medium from a state outside the European Economic Area if the conditions laid down in subsection 1 apply to the electronic storage medium.

Plain English

A credit or financial institution may accept an anonymous e-money payment from outside the EEA only if these same conditions apply to that instrument.

Obligation

May waive specified identification/data-retention/information-gathering duties for low-risk e-money only where all six listed risk-control conditions (value caps, Finland-only use, purchase-only use, no anonymous top-up, adequate monitoring, redemption caps) are met.

Where a credit or financial institution, or a crypto-asset service provider, enters into an agreement for the handling of payments and other assignments (a correspondent relationship) with a credit or financial institution established outside an EEA state, the credit or financial institution must, before entering into the agreement, obtain sufficient information on the counterparty credit or financial institution, or crypto-asset service provider, to understand its business. The credit or financial institution, or crypto-asset service provider, must assess the reputation and quality of supervision of the counterparty credit or financial institution, or crypto-asset service provider, and its measures to prevent money laundering and terrorist financing. The senior management of the credit or financial institution, or crypto-asset service provider, must approve the commencement of the correspondent relationship. The agreement must expressly address fulfilment of the customer due diligence duties and the provision, on request, of relevant data relating to them to the counterparty credit or financial institution. A credit or financial institution must not commence or continue a correspondent relationship with an institution that is a shell bank, or whose accounts can be used by shell banks. Where an investment firm, payment institution, fund management company or alternative investment fund manager, or an insurance company, enters into an agreement for an arrangement corresponding to that referred to in subsection 1, the provisions of this section must be complied with. When a credit or financial institution, or a crypto-asset service provider, offers payment-clearing accounts to other credit and financial institutions, it must ensure that the counterparty credit or financial institution, or crypto-asset service provider: (1) has identified the customers with direct access to the accounts of the credit and financial institution, or has verified the identity of the customers with direct access to the accounts of the crypto-asset service provider, and has applied ongoing customer due diligence to them; and (2) supplies it, on request, with the relevant customer due diligence data.

Plain English

Before entering a correspondent relationship with a credit/financial institution or crypto-asset service provider outside the EEA, a credit or financial institution must gather enough information on the counterparty to understand its business, assess its reputation, supervision quality and AML measures, obtain senior-management approval before starting the relationship, and document in the agreement how CDD duties and related information will be exchanged on request. It must never start or continue a correspondent relationship with a shell bank or an institution whose accounts shell banks can use. The same rules apply where an investment firm, payment institution, fund manager or AIFM, or insurance company enters an equivalent arrangement. When offering payment-clearing accounts to other credit/financial institutions, the entity must confirm the counterparty has identified (or, for crypto, verified) customers with direct access to its accounts and applies ongoing due diligence to them, and will supply relevant CDD data on request.

Obligation

Before and during a correspondent banking relationship with a non-EEA counterparty, gather sufficient information, assess reputation/supervision/AML controls, obtain senior-management approval, document information-sharing terms, never deal with shell banks, and verify payment-clearing-account counterparties' own customer due diligence.

An obliged entity must have in place appropriate procedures, based on a risk-based assessment, for establishing whether a customer or a customer's beneficial owner is, or has been, a politically exposed person, a family member of a politically exposed person, or a known close associate of a politically exposed person. Within the framework of the procedure referred to in subsection 1, political exposure must always be established whenever, on the basis of the obliged entity's risk assessment referred to in chapter 2, section 3, the obliged entity assesses that the customer relationship or individual transaction involves a higher than usual risk of money laundering or terrorist financing. Where the customer or the customer's beneficial owner is a politically exposed person, a family member of such a person, or a person known to be a close associate of such a person: (1) the obliged entity's senior management must approve the commencement of the customer relationship with that person; (2) the obliged entity must take appropriate measures to obtain an explanation of the origin of the wealth and of the funds connected with the customer relationship or the transaction; and (3) the obliged entity must arrange enhanced ongoing monitoring of the customer relationship. Once a person no longer holds a prominent public function, the obliged entity must, for at least 12 months, take into account the ongoing risk connected with that person and apply appropriate risk-based measures until the person is no longer considered to present a risk characteristic of a politically exposed person.

Plain English

An obliged entity must have risk-based procedures to determine whether a customer or beneficial owner is or has been a PEP, a PEP's family member or a PEP's known close associate; this must always be checked when the entity's own risk assessment flags higher-than-usual risk. Where the customer/beneficial owner is a PEP (or family member/associate), the entity's senior management must approve starting the relationship, the entity must take appropriate steps to establish the origin of the person's wealth and the funds involved, and must apply enhanced ongoing monitoring. After a person ceases to hold the prominent public function, the entity must still treat them as carrying ongoing risk for at least 12 months and apply appropriate risk-based measures until the PEP-specific risk no longer applies.

Obligation

Operate risk-based procedures to detect PEP status, obtain senior-management approval before starting a relationship with a PEP (or family member/close associate), establish the origin of wealth and funds, apply enhanced ongoing monitoring, and continue risk-based PEP treatment for at least 12 months after the person leaves office.

It may also report a single or linked payment above a self-set threshold; a money-remittance payment service provider must report every single or linked payment of at least EUR 1,000. A gambling intermediary may report via the gambling operator. The entity must give the FIU, free of charge, all data and documents necessary to investigate the suspicion, and respond to its information requests within a reasonable time it sets.

Obligation

Report suspicious transactions to the Financial Intelligence Unit without delay after completing the enquiry duty, and supply all necessary data/documents free of charge and respond to FIU information requests within the set time limit.

An obliged entity must retain, for five years, the data necessary for fulfilling the reporting duty laid down in section 1, together with the related documents. The data and documents must be kept separate from the customer register and must not be used for any purpose other than that provided for in this Act. The data and documents must be deleted five years after the end of the customer relationship or after the suspicious transaction was carried out, unless their continued retention is necessary for a criminal investigation, pending court proceedings, or to safeguard the rights of the obliged entity or of a person in its employment. The necessity of continuing to retain the data and documents must be examined at the latest three years after the previous review of that necessity. A note must be made of the review and of its timing. The data subject does not have the right to inspect the data referred to in subsection 1, nor the data and documents obtained to fulfil the duty of enquiry laid down in chapter 3, section 4(3). The Data Protection Ombudsman may, at the data subject's request, inspect the lawfulness of the processing of that data.

An obliged entity must not disclose the making or investigation of a report referred to in section 1 to the person to whom the suspicion relates, or to any other person. This duty of confidentiality also applies to a person in the obliged entity's employment, and to anyone who has received confidential information under this section. Notwithstanding the duty of confidentiality laid down in subsection 1, an obliged entity may disclose the fact that a report under section 1 has been made, and information on the content of the report, to another undertaking or entity belonging to the same group or other economic grouping that is licensed or registered in Finland or another EEA state, if the disclosure is necessary for assessing the suspicious transaction and the Financial Intelligence Unit has not requested that disclosure of the information be restricted. The information may be disclosed under the same conditions to an undertaking or entity belonging to the same group or other economic grouping that is licensed or registered in a state outside the EEA, if that undertaking or entity is subject to obligations equivalent to those laid down in this Act, and compliance with them is supervised. Notwithstanding the duty of confidentiality laid down in subsection 1, an obliged entity may disclose the fact that a report under section 1 has been made to an obliged entity referred to in chapter 1, section 2(1)(1) or (2), licensed in Finland or another EEA state, which is involved in an individual transaction connected with the customer and transaction to which the report relates. Under the same conditions, the information may also be disclosed to a corresponding obliged entity referred to in chapter 1, section 2(1)(1) or (2), licensed in a state outside the EEA, if the recipient of the information is subject to obligations equivalent to those laid down in this Act, and the undertaking or entity is subject to supervision of compliance with those obligations, and the recipient of the information is further subject to obligations equivalent to those on the protection of personal data laid down in the Data Protection Regulation. In connection with disclosing the information referred to in subsection 3, the customer's name, date of birth and personal identity code, and the grounds for making the report, may be given. If the person does not have a Finnish personal identity code, information on that person's nationality may also be disclosed.

Plain English

An obliged entity (and its staff, and anyone else who has received confidential information under this section) must not disclose to the subject of a suspicion, or to anyone else, that a suspicious-transaction report has been made or is being investigated ("tipping off" is prohibited). Despite that, disclosure is allowed between entities in the same group/economic grouping (in or outside the EEA, subject to equivalence conditions for non-EEA) where necessary to assess the suspicious transaction and the FIU has not restricted disclosure, and between unrelated obliged entities in the same single transaction (again subject to equivalence conditions outside the EEA, plus GDPR-equivalent data protection). Where disclosure is permitted, the entity may share the customer's name, date of birth and personal ID (or nationality if no Finnish ID) and the grounds for the report.

Obligation

Do not disclose (tip off) that a suspicious-transaction report has been made or is being investigated, subject to the narrow permitted-disclosure exceptions to group entities and transaction counterparties set out in this section.

Prohibited action

Translation (Machine translation, unofficial)

An obliged entity must suspend a transaction pending further enquiries, or refuse the transaction, if: (1) the transaction is suspicious; or (2) the obliged entity suspects that funds involved in the transaction are being used for terrorist financing or an attempt at the punishable commission of that offence. If the transaction cannot be left unfinished, or if suspending or refusing the transaction would be likely to make it more difficult to establish the beneficial owner of the transaction, the obliged entity may complete the transaction. Provisions on the Financial Intelligence Unit's right to order the suspension of a transaction for a fixed period are laid down in section 6 of the Act on the Financial Intelligence Unit.

Plain English

An obliged entity must suspend a transaction for further investigation, or refuse it, where the transaction is suspicious or the entity suspects the funds involved will be used for terrorist financing or an attempt at it. However, the entity may complete the transaction if it cannot be interrupted, or if suspending/refusing it would likely make it harder to identify the transaction's beneficial owner; the FIU's own power to order a time-limited suspension is addressed elsewhere (section 6 of the FIU Act).

Obligation

Suspend a transaction for further enquiries, or refuse it, where it is suspicious or suspected to involve terrorist-financing funds, unless completing it is unavoidable or suspension/refusal would hinder identifying the beneficial owner.

Prohibited action
